1. Acceptance of Terms

Welcome to TRÉA. These Terms of Service ("Terms") govern your access to and use of the website located at trea.world (the "Site") and your purchase of any products from Trea World Inc. ("TRÉA," "we," "us," or "our").

By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, please do not use the Site or purchase our products.

These Terms constitute a legally binding agreement between you and TRÉA. Please read them carefully.

3. Eligibility and Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase products or create an account.

You may be able to browse the Site without an account, but certain features, including subscriptions and order history, may require you to create one. If you create an account, you agree to provide accurate and complete information and to keep it up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us promptly at hi@trea.world if you believe your account has been accessed without authorization.

4. Products, Descriptions, and Pricing

We try to describe and display our products as accurately as possible, including ingredients, flavor, and packaging. However, we do not warrant that product descriptions, images, colors, or other content on the Site are complete, current, or error-free. Actual product may vary slightly from images shown.

All prices are listed in U.S. dollars and are subject to change at any time without notice. Applicable taxes and shipping charges are calculated and shown at checkout.

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information, including pricing, at any time without prior notice. If a product is listed at an incorrect price due to an error, we reserve the right to cancel or refuse any order placed for that product, whether or not the order has been confirmed and your payment method charged. If your payment method has already been charged and we cancel the order, we will issue a refund in the amount of the charge.

5. Orders, Acceptance, and Payment

When you place an order, you are making an offer to purchase. Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to accept, decline, or cancel any order for any reason, including suspected fraud, product unavailability, or errors in pricing or product information.

Payment is due at the time you place your order. We accept the payment methods listed at checkout. By submitting payment information, you represent that you are authorized to use the payment method and you authorize us (and our payment processor) to charge the full order amount, including taxes and shipping.

You are responsible for any applicable sales, use, or similar taxes, which will be calculated and displayed at checkout where required.

6. Shipping and Delivery

Shipping costs and estimated delivery times are shown at checkout and are also described in our Shipping Policy. Shipping charges are the responsibility of the customer unless otherwise stated.

Estimated delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, weather, customs, or other circumstances beyond our reasonable control.

Title and risk of loss for products pass to you upon our delivery of the products to the carrier. If a package is lost or damaged in transit, please contact us at hi@trea.world and we will work with you and the carrier to resolve it, though we cannot guarantee a particular outcome.

7. Returns, Refunds, and Cancellations

Because our products are consumable food items, we are generally unable to accept returns of opened or used products for health and safety reasons.

If your order arrives damaged, defective, or incorrect, please contact us at hi@trea.world within 14 days of delivery with your order number and a photo of the issue. We will arrange a replacement or refund for the affected item at our discretion.

Unopened products in their original condition may be eligible for return within 30 days of delivery; the customer is responsible for return shipping unless the return is due to our error. Refunds, where approved, are issued to the original payment method and may take several business days to appear.

Our full return and refund process is described in our Refund Policy. Subscription cancellations and refunds are governed by Section 8 below.

8. Subscriptions and Auto-Renewal

TRÉA offers a subscription option that delivers products on a recurring basis. By enrolling in a subscription, you agree to the following:

Recurring billing. Your subscription automatically renews at the frequency you select. Each renewal, your payment method is automatically charged the then-current subscription price plus applicable taxes and shipping, until you cancel.
Price. Your subscription price is shown at the time of enrollment. We will provide advance notice of any price change before it takes effect, as required by law.
Consent. By enrolling, you affirmatively authorize these recurring charges. The subscription terms, billing frequency, and price are disclosed to you before you complete enrollment.
Cancellation. You may cancel, pause, or skip your subscription at any time through your online account, or by contacting us at hi@trea.world. Cancellation takes effect for the next unprocessed billing cycle; orders already processed before your cancellation cannot be canceled.
Easy online cancellation. If you enrolled online, you may cancel online through your account at any time, without having to call, visit, or complete additional retention steps.
Refunds. If you cancel before an upcoming shipment has been processed, you will not be charged for that shipment. Charges for shipments already processed are non-refundable except where the product arrives damaged, defective, or incorrect, as described in Section 7.

We will send you any renewal or cancellation confirmations required by applicable law.

9. Product, Health, and Allergen Information

Our products are foods intended to be enjoyed as beverages. They are not intended to diagnose, treat, cure, or prevent any disease, and no statement on the Site or packaging should be interpreted as a medical or health claim.

Caffeine. Our tea contains caffeine. If you are sensitive to caffeine, pregnant, nursing, or have a medical condition, please consult your healthcare provider before consuming.
Allergens and ingredients. Ingredient information is provided on the product packaging and on the Site. Please review it before consuming, particularly if you have allergies or dietary restrictions.
Your responsibility. You are responsible for reviewing ingredient and allergen information and for determining whether a product is suitable for you.

10. Intellectual Property

All content on the Site — including the TRÉA name, logo, packaging designs, artwork, photographs, text, graphics, and the overall look and feel — is owned by or licensed to Trea World Inc. and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from any of our content without our prior written permission. Nothing on the Site grants you any license or right to use any TRÉA trademark, brand element, or copyrighted material.

If you submit any content to us (for example, reviews, photos, or social media posts that tag us), you grant TRÉA a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business and marketing, unless we agree otherwise in writing.

11. User Conduct

When using the Site, you agree not to:

Use the Site for any unlawful purpose or in violation of these Terms;
Attempt to gain unauthorized access to the Site, other accounts, or our systems;
Interfere with or disrupt the Site, including by introducing malware or placing excessive load on our infrastructure;
Use any automated means (bots, scrapers) to access or collect data from the Site without our permission;
Submit false, misleading, or fraudulent information, including in connection with orders or reviews; or
Infringe the intellectual property or other rights of TRÉA or any third party.

We reserve the right to suspend or terminate your access to the Site or your account if you violate these Terms.

12. Disclaimers and Limitation of Liability

Disclaimer of warranties. Except as expressly required by law, the Site and products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free. Nothing in these Terms limits any warranty or right that cannot be excluded or limited under applicable law, including under the laws of the state where you reside.

Limitation of liability. To the maximum extent permitted by law, TRÉA and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, arising out of or related to your use of the Site or products, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability arising out of or related to these Terms or your purchase will not exceed the amount you paid to TRÉA for the product(s) giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Trea World Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any rights of a third party.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or your purchase will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there. Nothing in this section limits any right you may have to bring a qualifying claim in small-claims court.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "last updated" date at the top of this page and, where required by law or where changes are material, provide additional notice. Your continued use of the Site or purchase of products after changes take effect constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
